Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Rentstead platform operated by Rentstead LLC, a Delaware limited liability company ("we", "us", or "our"). By using our service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and a legal resident of the United States to use Rentstead. By creating an account, you represent that you meet these requirements and that all information you provide is accurate and complete.
2. Account Security
All Rentstead accounts require mandatory two-factor authentication (2FA). You are responsible for maintaining the security of your account credentials and 2FA device. You must notify us immediately if you suspect unauthorized access to your account.
You are responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from unauthorized use of your account.
3. Subscription and Pricing
Rentstead is offered as a monthly subscription at the price displayed at the time of signup. Our standard pricing is $18/month for unlimited units with no per-unit or transaction fees. Annual plans and promotional offers (such as founding member pricing) are subject to the specific terms presented at the time of purchase.
- Subscriptions renew automatically at the end of each billing period unless cancelled.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- We reserve the right to change pricing with 30 days' notice. Promotional or locked-in pricing will be honored for the duration specified at the time of offer.
- Refunds are handled on a case-by-case basis.
4. Rent Collection and Payments
Rent collection is processed through Stripe using ACH Direct Debit. Rentstead facilitates the transfer of funds but does not hold or control tenant payments directly.
- We aim for 1-2 business day ACH clearing, but actual settlement times depend on banking partners and may vary.
- Rentstead is not responsible for failed transactions due to insufficient funds, incorrect bank details, or issues with third-party payment providers.
- You are responsible for complying with applicable landlord-tenant laws regarding rent collection, late fees, and payment processing in your jurisdiction.
5. Tenant Screening
Tenant screening services (credit checks, background checks, income verification) are provided through third-party partners. Screening fees are paid by the applicant unless otherwise agreed.
- Income verification through Plaid requires the applicant's explicit consent to access their bank account data.
- Screening results are provided for informational purposes. You are responsible for making rental decisions in compliance with the Fair Housing Act and applicable state and local laws.
- We do not guarantee the accuracy or completeness of screening data provided by third-party sources.
6. Electronic Signatures
Rentstead offers electronic lease signing through Dropbox Sign. By using this feature, you agree that electronic signatures are legally binding under the Electronic Signatures in Global and National Commerce Act (E-SIGN) and the Uniform Electronic Transactions Act (UETA). You are responsible for ensuring your leases comply with applicable state and local laws.
7. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose or in violation of any applicable laws
- Upload or transmit malicious code, viruses, or harmful data
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the service to harass, discriminate against, or threaten any person
- Reproduce, distribute, or resell any part of our service without permission
- Provide false or misleading information in your account or listings
We reserve the right to suspend or terminate accounts that violate these terms.
8. Intellectual Property
The Rentstead name, logo, and all related content, features, and functionality are owned by Rentstead LLC and are protected by copyright, trademark, and other intellectual property laws. You may not use our branding without prior written permission.
You retain ownership of all content you upload to the platform (leases, photos, documents). By uploading content, you grant us a limited license to store and display it as needed to provide our services.
9. Limitation of Liability
To the maximum extent permitted by law, Rentstead and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to:
- Loss of rent or income due to payment processing delays or failures
- Damages resulting from tenant screening decisions
- Loss of data or unauthorized access to your account
- Service interruptions or downtime
Our total liability for any claim arising from these Terms shall not exceed the amount you have paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Rentstead from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.
11. Dispute Resolution
Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware. You agree to waive any right to a jury trial or class action.
12. Termination
You may terminate your account at any time by contacting us. We may terminate or suspend your account if you violate these Terms or for any other reason with reasonable notice. Upon termination, you will have a reasonable period to export your data.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the platform at least 30 days before they take effect. Continued use of the service after changes constitutes acceptance of the updated Terms.
